Terms & Conditions

Please read these terms carefully before using FacePOS services.

Welcome to FacePOS. These Terms and Conditions (“Terms”) govern your access to and use of the FacePOS website, mobile application, portals, payment services, and any related systems (collectively, the “Services”) provided by FacePOS Limited (“FacePOS”, “we”, “us”, “our”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

These Terms are subject to regular updates, and we will notify all users of any material changes. Your continued use of the Services after changes constitutes acceptance of the revised Terms.

1. App Download & Registration

To begin using FacePOS, download our app from the Google Play Store or Apple App Store. Ensure your device meets the minimum requirements for optimal performance. You must be at least 18 years of age to register for an account.

  • Provide accurate and complete information during registration
  • Maintain the confidentiality of your login credentials
  • Notify us immediately of any unauthorised access to your account
  • You are responsible for all activity under your account

2. Account Setup & Verification

After downloading the FacePOS app, you will be prompted to provide essential information to set up your account. This includes uploading a recent photograph, which is used for the facial recognition feature of our payment system.

FacePOS uses proprietary facial recognition technology for identity verification. Your biometric data is encrypted, stored securely, and never shared with third parties. See our Privacy Policy for full details.

We may require additional identity verification (KYC) in compliance with anti-money laundering regulations. This may include proof of identity (passport, driver's licence) and proof of address (utility bill, bank statement).

3. Bank Account Linking

To activate payment functionality, you will need to link your bank account to the FacePOS app. Enter your banking details as prompted. Your bank will send you a confirmation to authorise FacePOS as your electronic payment processor.

  • FacePOS uses Open Banking (via our regulated partner Tink) to securely connect to your bank
  • We never store your bank login credentials
  • You may revoke bank access at any time through your banking app or by contacting us

4. Consent for Payment Processing

By confirming the bank linking request, you authorise the FacePOS app to handle your transactions. FacePOS will process payments using our secure facial recognition technology to authenticate your identity each time you use our service.

You acknowledge that each payment initiated through FacePOS constitutes your explicit consent to debit the linked account for the specified amount. Transactions are processed in real time and cannot be reversed once completed.

5. Use of Services

Upon successful setup, you can start using FacePOS for your payment needs. Our service is designed to offer a secure, quick, and user-friendly payment experience. You agree to:

  • Use the Services only for lawful purposes
  • Not attempt to circumvent security features or authentication
  • Not use the Services for money laundering, fraud, or any illegal activity
  • Not interfere with or disrupt the Services or servers
  • Comply with all applicable laws and regulations

6. Location & Camera Access

FacePOS may request access to your device's location and camera for the following purposes:

  • Location– To provide location-based services and comply with regulatory requirements
  • Camera– For facial recognition login, identity verification, and QR code scanning
  • Contacts– Optionally, to invite friends to FacePOS (never shared or sold)

You can revoke these permissions at any time through your device settings, though some features may not function without them.

7. Fees & Charges

FacePOS may charge fees for certain services. Any applicable fees will be clearly disclosed before you confirm a transaction. Fee structures may vary by account type:

  • Personal accounts– No monthly fees for standard usage
  • Business accounts– Transaction-based fees as per your merchant agreement
  • Currency conversion– Fees may apply for cross-border or multi-currency transactions

We reserve the right to update our fee schedule with 30 days' notice.

8. Data Security

We take the security of your data seriously. All data is encrypted using industry-standard protocols and stored on secure infrastructure. We implement:

  • End-to-end encryption for all transactions
  • Multi-factor authentication
  • Regular security audits and penetration testing
  • Compliance with GDPR and applicable data protection laws

9. Intellectual Property

All content, trademarks, logos, software, and technology associated with FacePOS are the property of FacePOS Limited or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of our Services without prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law, FacePOS shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Service interruptions caused by third-party providers or force majeure
  • Unauthorised access resulting from your failure to safeguard credentials

Our total liability for any claim shall not exceed the fees paid by you in the 12 months preceding the claim.

11. Termination

You may terminate your account at any time by contacting us or through the app settings. FacePOS reserves the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

  • Personal accounts– Can be closed at any time with no penalty
  • Business accounts– May be terminated with one month's written notice; no exit charges apply
  • All outstanding fees must be paid in full prior to account closure

12. Dispute Resolution

If you have a dispute regarding our Services, please contact us first at support@facepos.ie. We will make reasonable efforts to resolve complaints within 15 business days.

If the matter is not resolved, you may refer your complaint to the relevant regulatory authority in your jurisdiction.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland, without prejudice to your rights under EU consumer protection law.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. Material changes will be communicated via email or in-app notification. Last updated: 12 June 2025.
